AirBro Mechanical Maintenance Plan Terms and Conditions

This AirBro Mechanical Maintenance Plan Terms and Conditions sets forth the terms and conditions under which We will provide You the Services described below and in Your Order Confirmation (collectively, the “Agreement”). Please read the Agreement carefully. Coverage is limited to routine maintenance, and certain exclusions apply. This is not a repair plan for major system failures.

DEFINITIONS

  • Administrator: Refers to AirBro Mechanical, located in Texas. To schedule Service, refer to Your Order Confirmation to contact the Administrator’s office.

  • Agreement: Refers to this document and includes the Order Confirmation.

  • Authorized Repair Technician: The repair person We dispatch in response to Your call.

  • Coverage Period: The duration of this Agreement, as identified in Section 5.

  • Covered System: Any system or component included in the specific Plan You purchased, subject to routine maintenance services only.

  • Effective Date: The date stipulated on the Order Confirmation.

  • Eligible Facility: A single-family residence or small business in Our service area, with a heating or air conditioning unit of five tons or smaller, located within a permanent foundation.

  • Enrollment Form: The form You completed online or by phone to enroll in the Plan.

  • Equipment: Includes natural gas or electric furnaces, air handlers, heat pumps, electric central air conditioners, package units, mini-split systems, and attached humidifiers eligible for coverage under the Plan.

  • Order Confirmation: The written or electronic communication indicating the Plan You selected and payment details.

  • Plan: The AirBro Mechanical Maintenance Plan You purchased as indicated on Your Order Confirmation.

  • Products: HVAC-related products available for Your Plan at the Eligible Facility.

  • Service or Services: Includes routine maintenance as per this Agreement. Major repairs or replacements are not covered.

  • Trade Call Fee: An amount due by You for a service visit by an Authorized Repair Technician, as identified during the Enrollment process.

  • We, Us, Our: AirBro Mechanical.

  • You, Your: The resident or owner of the Eligible Facility covered by the Plan.

IMPORTANT INFORMATION

This Agreement provides for routine maintenance of specified Equipment to ensure its performance and efficiency. This is not a contract for insurance or major repairs. The obligations under this Agreement are backed only by the full faith and credit of AirBro Mechanical and are not guaranteed under a reimbursement insurance policy.

The purchase of coverage is not mandatory, and similar services may be purchased through another provider. Refrigerant leak tests are included as part of routine maintenance, but any refrigerant added will incur an additional charge.

SERVICES

The Plan You selected covers routine maintenance to maintain the performance of Equipment. This includes inspections, cleaning, and diagnostic tests as per the Plan selected. Major repairs or replacements are excluded from this Plan.

  • Installation: If Products are included in Your Plan, We will install and assist with registration at the Eligible Facility. Unanticipated site conditions may result in additional costs or cancellation of Installation.

ELIGIBILITY

Equipment must meet the following conditions:

  1. Located within the confines of the permanent foundation of the Eligible Facility.

  2. Properly installed on the Effective Date.

  3. Safely and easily accessible for routine maintenance by the Authorized Repair Technician.

  4. Located in a safe environment for the Authorized Repair Technician.

TERM AND AUTOMATIC RENEWAL

The Coverage Period of this Agreement starts on the Effective Date and continues for one year. After the Coverage Period, this Agreement automatically renews in additional one-year increments unless terminated in writing within 10 days after the anniversary date.

CHANGES TO AGREEMENT

We will provide written notification of any material changes 45 days before implementation. You may terminate the Agreement within the 45-day notice period if You do not agree to the changes.

PAYMENTS

  • Payments are due monthly, as stated on the Order Confirmation.

  • Payment methods include Electronic Fund Transfer or preauthorized credit card.

  • Non-payment may result in suspension of coverage.

CANCELLATION

Cancellation by Us: We may cancel the Plan immediately for non-payment, fraud, or material misrepresentation. Otherwise, We will provide 30 days’ notice.

Cancellation by You: You may cancel at any time by providing written notice. A $100 administrative fee applies unless canceled within 30 days of the Effective Date and no services have been provided.

UNAVAILABLE PARTS OR NON-REPAIRABLE EQUIPMENT

If parts are unavailable or Equipment cannot be repaired at a reasonable cost, We may terminate this Agreement. Refunds will be calculated as described in Section 8.

WARRANTY AND LIMITATION OF LIABILITY

  • Repairs are covered for 90 days after the original repair date if provided under separate agreements.

  • Our liability is limited to routine maintenance and will not exceed direct actual damages related to maintenance services.

YOUR RESPONSIBILITIES

  • Use Products per provided instructions.

  • Notify Us immediately of any emergency conditions.

  • Do not modify or tamper with Products without prior written consent.

PRIVACY POLICY

We collect and use Your Personally Identifiable Information (PII) as outlined in our Privacy Policy. By enrolling, You consent to the use of Your data for providing Services and marketing purposes. For more details, visit our Privacy Policy at AirBroMechanical.com/privacy-policy.

EXCLUSIONS

The following are not covered under this Agreement:

  • Major repairs or system replacements.

  • Consumable items such as filters, batteries, and refrigerant (unless specified).

  • Damage caused by external factors, misuse, or unauthorized repairs.

  • Structural or cosmetic repairs to the property.

GOVERNING LAW

This Agreement is governed by the laws of Texas. Any disputes will be resolved in accordance with Texas state law.
